1. These Terms and Conditions are between First Aid North East Ltd and the Customer. They replace any previous Terms and Conditions of First AidNorth East Ltd, and are the complete and only Terms and Conditions between the parties. All dealings between First Aid North East Ltd and the Customer shall be governed by these Terms and Conditions.

2. These Terms and Conditions and any contract formed pursuant to them may be varied, provided any variation is confirmed in writing by an authorised representative of First Aid North East Ltd.

3. A binding contract will be formed when First Aid North East Ltd notifies its acceptance of a Customer’s order for services (the ‘Contract’). 

Invoicing and Payment

4. For both On-Site Training and Open Courses, the person booking will either be required to pay at the time of booking, or any time before the course start date.

5. We have a limited number of spaces on our Open Courses therefore payment is considered due from the invoice date, as the invoice is for the reserved seat and not physical attendance.

6. In the provision of a training course by First Aid North East Ltd, certificates to prove completion of the course may be withheld by First Aid North East Ltd until payment is made.

7. No refund shall be given, and the full course fee shall remain payable should a learner fail any assessment on our courses. First Aid North East Ltd makes no guarantee as to a learner successfully passing any course. If a delegate does not attend, the full course fee shall remain payable, and no refund shall be given. The Customer’s responsibility is to ensure that a delegate is booked on and attends the correct course. If a delegate attends a course and payment has not yet been made, the Customer accepts that payment is overdue.
   
   
8.  Unpaid Invoices First Aid North East Ltd will not issue certification until payment has been received in full. First Aid North East Ltd reserve the right to charge interest on late payments.

Invoices 60 days or more from the invoice date are liable to interest and debt recovery costs. Interest shall be charged daily at the Bank of England base rate + 8.5% on the outstanding gross amount inclusive of VAT (No VAT is chargeable on the interest itself). Under late payment legislation, debt recovery costs will be charged as follows:

9. Booking and Cancellations If the Customer wishes to cancel an On-Site or Open Course booking, the Customer must notify First Aid North East Ltd in writing by email, stating the booking reference number or Invoice number. For the avoidance of doubt, the Notice of Cancellation will not be accepted by telephone. 

• If First Aid North East Ltd receives a Notice of Cancellation more than 10 working days before the course’s commencement, First Aid North East Ltd shall give a refund of any course fees paid.

• If First Aid North East Ltd receives a Notice of Cancellation less than 10 working days before the course’s commencement, the full course fee shall remain payable, and First Aid North East Ltd shall give no refund.

10. Transfer of Individuals on Open Courses Only one transfer is permitted to an alternative classroom training session. However, this option is only possible where at least ten working days’ notice is given before the classroom training. Unfortunately, cancellations/transfers cannot be accepted over the phone and must be made via email.

11. Substitution of Individuals on Open Courses Candidates can be substituted any time before the open course start date. Requests are to be sent by email quoting the booking reference or invoice number, original learner name and new learner name. Once the request has been actioned, a confirmation email will be sent.

12. Interest on overdue invoices may be charged (at the discretion of First Aid North East Ltd) under the Late Payment of Commercial Debts (Interest) Act 1998 until the date of payment, and the Customer agrees to pay any reasonable expenses (not limited to expenses fixed by Court) incurred by First Aid North East Ltd in pursuing any outstanding debt or debts due from the Customer.

13. First Aid North East Ltd reserve the right to cancel/amend course dates, times and venues. Every effort will be made to give the Customer as much notice as possible and offer a reasonable alternative. If these are unsatisfactory, First Aid North East Ltd shall refund the course’s price in full. No further compensation will be given.

14. The Customer shall compensate First Aid North East Ltd for any loss or expenses caused by providing inaccurate information to us, mistakes contained within the Customer’s order, changes to the Contract requested by the Customer or personal injury or death caused by the Customer not following First Aid North EastLtd’s guidelines correctly.

15. If the Customer becomes bankrupt or enters into liquidation, administration or administrative receivership or has a receiver of any of its assets appointed (or ceases or threatens to cease carrying on business), First Aid North East Ltd shall be entitled to cancel any outstanding Contract/Order without liability to the Customer. Any sums outstanding shall become immediately due and payable.

16. No other person or body who is not a party to the Contract has any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce the Contract’s terms.

17. Any written notice under these terms and conditions shall be served either by registered post to the relevant party’s business address.

18. These Terms and Conditions shall be governed and construed under English law, and the parties submit to the exclusive jurisdiction of the English Courts.
    
    

19. First Aid at Work Refresher Certification

The Customer’s responsibility is to ensure that attendees attending a 2-day First Aid at Work Refresher course hold proof of having a valid 3-day First Aid at Work certificate. If the certificate has passed its expiry date, it is the Customer’s responsibility to decide whether it is appropriate for the attendee to attend the Refresher course. The 2-day First Aid at Work Refresher course may only be completed 3 months up to expiry, or within a month after expiry.

If First Aid North East Ltd issues a certificate to a Learner on successfully completing a Refresher course and subsequently finds out that they did not complete the Initial 3-day First Aid at Work training, the First Aid at Work Refresher certificate will be invalid and downgraded to the 1-day Emergency First Aid at Work. This is regardless of the success of the attendee at the Refresher course.

20. Certification Accreditation

Candidates completing the 3-day First Aid at Work and 1-day Emergency First Aid at Work courses will receive First Aid North East Ltd certification as proof of competence which is valid for three years. Accredited by The First Aid Industry Body (F.A.I.B.), these courses are monitored, approved and quality assured to meet the guidelines set out by the H.S.E. in October 2013 and meets the requirements of the Health & Safety (First Aid) Regulations 1981.

Candidates completing the 2-day Paediatric First Aid course will receive First Aid North East Ltd certification as proof of competence valid for three years. Accredited by The First Aid Industry Body (F.A.I.B.), this course meets Ofsted requirements and the Early Years Foundation Stage (E.Y.F.S.) statutory framework requirements.

First Aid North East Ltd can deliver Ofqual regulated qualifications. Although Ofqual is not mandatory, should you require certification via this route, we would need to know at the time of booking, and there would be an additional cost of £10.00+VAT per person/certificate.

21. Certification Replacements

Replacement certificates will be supplied electronically free of charge. We no longer issue certificate hardcopies.
